在长期缺乏法治土壤的环境之下,推进依法行政、建设法治政府既是一项具有时代里程碑意义的的任务,同时也是一项长期而艰难的任务。十八届四中全会明确提出“深入推进依法行政,加快建设法治政府”的任务,并且以踏石留印、抓铁有痕的实干精神推动这项任务的完成,彰显了我国建设法治政府的决心。 然而,建设法治政府并非一项易事。一方面,应当加强政府自身建设,努力提高政府及其工作人员的法治意识,加强行政机关内部自我监督;另一方面,还应当加强对行政机关的外部监督,特别是立法监督和司法监督,而行政诉讼是公民、法人和其他社会组织通过司法机关监督政府的一种有效方式。我国《行政诉讼法》自1990年实施以来,“民告官”的情况得到了明显的改善,但是仍然面临着“立案难、审理难、执行难”三座大山。新行政诉讼法的修改在很大程度上便利了相对人提起行政诉讼,同时在审理、执行等阶段也加强了对行政机关的约束。

The development of administration according to law and the construction of the government under rule of law is not only an epoch-making milepost, but also a long-term and arduous task. On the one hand, the government should put efforts to improve its governance and its staffs’ awareness of the rule of law, as well as to strengthen the internal supervision of administrative organs. On the other hand, the external supervision of administrative organs, especially the legislative and judicial supervision, shall also be focused. In this way, the administrative litigation is one of the influencing methods that a citizen, legal person and other social organization could use as an effectively judicial supervision of the government. Since 1990 when Administrative Procedure Law was implemented, "people suing officer" dilemma has been obviously improved. The new modification of Administrative Procedure Law has facilitated the involved parties in administrative proceedings with more convenience when filing a case as well as at the trial stage

“非行政许可审批”,是指由行政机关及具有行政执法权的事业单位或其他组织实施的,除依据法律、法规和国务院决定等确定的行政许可事项外的审批事项,是属于《行政许可法》等法律调整的“灰色地带”。这种不受《行政许可法》等法律调整的审批权为许多部门提供的权力寻租、设租的空间。 李克强总理指出,“我们取消非行政许可审批,制定权力清单,其目的就是为了划定政府权力的‘边界’,”“对非行政许可审批事项,该取消的就要取消,该转化就要合理转化。政府做事一定要光明正大,决不能再搞‘模糊边界’、再玩‘模糊权力’!”总理的这番发言可以说表明了我国推进依法行政、建设法治国家的决心。

 

"Non-licensing administrative examination and approval", refers to the examination and approval implemented by the administrative organs and institutions with administrative enforcement authority, but not listed in the administrative licensing items determined by the administrative laws and regulations. In other words, this kind of administrative approvals lied in the “grey area” of the administrative laws and regulations, which facilitates some authorities with rent-seeking conducts. However, the era of non-licensing administrative examination and approval has been put an end. Premier Li Keqiang pointed out in one of his speeches that the elimination of non-licensing administrative approval, and formulating of a list of powers, aims at clarifying the "government boundary", which demonstrated the China’s determination in improving governance ruled by law.
